Establishing a Case for Medical Negligence & Compensation Claims
Should you have received treatment that was not to a standard that could be reasonably expected – you have a premise and a basis to create a medical negligence & compensation claim. Should your claim progress against a medical practitioner – they will have a valid defence to your claim if treatment is within line and the view of a responsible body of medical opinion.
This, therefore, results in you having to prove that your injuries would not have occurred if it was not for the negligent treatment of your practitioner. In some cases such as injuries caused by misdiagnosis of an illness or an injury from an illness being treated – you do not have to prove this. This is due to the fact that injuries would have occurred regardless.
At some point during your claim, you will also need to receive a medical report from a medical expert. This report advises on whether treatment provided was sufficient and to a standard that could be reasonably expected. This report will also advise on whether the injury would have occurred even if negligent treatment had not taken place in relevant cases.
