How to Determine When Negligence Has Occurred

When or whether a medical practitioner has been negligent depends on whether the treatment that you received was to a standard that could be reasonably expected. If a claim is made with the treatment being received in line with the views of a responsible body of medical opinion – your practitioner would have a defence to your claim.

Additionally to this – you will need to prove that your injuries would not have occurred if it were not for the negligence of your practitioner. Some cases such as an injury being caused by the actual illness being treated or cases in which quality of life reduces due to misdiagnosis – injury may have occurred anyway,

During the process of making your claim, you will need to obtain a medical report from a medical expert. This report is to advise whether treatment provided was negligent/sufficient as well as if the injury would have occurred even if the negligent treatment had not taken place.

Time Limits

If Court Proceedings are not issued within 3 years of that date you would usually be unable to pursue your claim further. The Courts can however waive this 3-year time limit if it can be shown that there was a valid reason why you did not pursue the claim sooner.
